Terms of Services 

1. DEFINITIONS

In this document, the following words have these meanings:
“You”, “Your”, “Customer”, “Member(s)”, or “User(s)” means a “Subscriber” to the Service, or any person who accesses the Service using the subscriber’s access details;
“Service(s)” means any product(s) or service(s) the Customer has ordered for use.
“WebHoster.ae”, “WebHosterAE”, “WebHoster”, “We”, “Us”, “Our” means WebHoster (UAE Trade License #1234567).
“ToS” means Terms of Service.
“AUP” means Acceptable Use Policy.
“SLA” means Service Level Agreement.
“Agreement(s)” means “ToS”, “AUP”, “SLA” and “Privacy Policy”.
“Members Area” or “Client Area” means our online portal to manage all Products and Services and not limited to the members domain name(s), web hosting, dedicated servers, and security certificates, direct access to the WebHoster.ae Members Area: https://www.WebHoster.ae
“Website” means www.WebHoster.ae.

2. GENERAL

These terms and conditions of Service (collectively, with WebHoster.ae’s “Service Level Agreement” or “Acceptable Use Policy”) govern Your use of the Website and the Services, features, content or applications operated by WebHoster.ae (together with the Website, the “Services”), and provided to the Subscriber. Please read these Terms of Service carefully before using the Services. If You do not agree to these terms of service, You must not use the Services and should exit the website and stop use of the services immediately. These Terms of Service apply to all Users of the Services, including any sub-users of the User’s Service. Using the Services in any manner constitutes Your acceptance and agreement to be bound by these Terms of Service, and all other operating rules, policies and procedures that may be published from time to time on the Website by us, each of which is incorporated by reference and may be updated from time to time without notice to You. In purchasing our Services and entering into this agreement, You warrant that You are no legal impediment from doing so and that this agreement will be legally enforceable against You in accordance with its terms. WebHoster.ae reserves the right, at any time and from time to time, to amend or to modify these Agreements without prior notice to You, provided that if any such alterations constitute a material change to these Terms of Service, WebHoster.ae will notify Users via their listed Members Area email address. Amendments and modifications shall take effect immediately when posted on the Website. By continuing to access or use the Services after any such amendments or modifications, You agree to be bound by such amended or modified Terms of Service.

3. SEVERABILITY

If any provision of this Agreement is prohibited by law or held to be unenforceable under UAE law, that provision will be severed and the remaining provisions hereof shall not be affected such that this Agreement shall continue in full force and effect as if such unenforceable provision had never constituted a part hereof.

4. LIMITATION OF LIABILITY

IN NO EVENT SHALL WE, NOR OUR DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS OR CONTENT PROVIDERS, BE LIABLE UNDER CONTRACT, TORT, STRICT LIABILITY, NEGLIGENCE OR ANY OTHER LEGAL OR EQUITABLE THEORY WITH RESPECT TO THE SERVICES:
(I) FOR ANY LOST PROFITS, DATA LOSS, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, COMPENSATORY OR CONSEQUENTIAL DAMAGES OF ANY KIND WHATSOEVER;
(II) FOR ANY NON-RENEWAL OF THE SERVICES;
(III) FOR ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE;
(IV) IN CONNECTION WITH OUR ANTI-SPAM OR VIRUS FILTERS; OR
(V) FOR ANY DIRECT DAMAGES IN EXCESS OF FEES PAID TO US FOR THE PARTICULAR SERVICES DURING THE IMMEDIATELY PREVIOUS ONE MONTH PERIOD.

YOU ACKNOWLEDGE THAT THE FEES PAID REFLECT THE ALLOCATION OF RISK AND YOU HEREBY WAIVE ANY AND ALL CLAIMS AGAINST WEBHOSTER.ae ARISING OUT OF YOUR PURCHASE OR USE OF THE SERVICES. YOUR SOLE REMEDY IN CASE OF DISSATISFACTION SHALL BE:
(A) RELYING UPON UAE CONSUMER LAW; OR
(B) TERMINATION AND DISCONTINUATION OF ACCESS TO THE SERVICES.

5. WARRANTY DISCLAIMER

The Services and Content are provided “AS IS”, “AS AVAILABLE” without warranty of any kind. WEBHOSTER.ae does not guarantee security, uptime, or error-free operation. Your use of the Services is at your own risk.

6. INDEMNIFICATION

You shall defend, indemnify, and hold harmless us, our affiliates, licensors, and partners from all liabilities, claims, and expenses arising from your use or misuse of the Services, violation of these Terms of Service, or infringement of any rights.

7. DOMAIN REGISTRATION AND RENEWAL

WebHoster.ae is an authorised reseller of ResellerClub and registers “.AE” domains with the relevant UAE domain authority. You must comply with UAE domain registration rules. WebHoster.ae is not liable for disputes with domain providers or non-renewal if payment is not made.

8. BILLING

Invoices are sent monthly via email. Payments must be made in AED by the due date. Failure to pay may result in suspension or termination.

9. SERVICE FEES

Setup fees and annual service fees apply. Fees are non-refundable unless explicitly stated. Accounts past due may be suspended or deleted.

10. PROMOTIONS

Free domain offers apply only to the first-year registration with eligible hosting plans. Domains must be primary domains and requested at time of order.

11. MONEY BACK GUARANTEE / REFUND POLICY

12. FAILURE TO PAY

WebHoster.ae may deny Service or terminate the agreement if payments are not made on time. You remain responsible for all charges accrued.

13. SECURITY & SOFTWARE

You are responsible for maintaining third-party software (e.g., WordPress, Joomla) installed on your hosting. WEBHOSTER.ae is not liable for data loss or hacking resulting from third-party software.

14. TERMINATION & SUSPENSION

WEBHOSTER.ae may suspend or terminate your account for breach of Terms, misuse of resources, or legal requirements. Fees paid are non-refundable. All rights to content terminate upon account closure.

15. FILE HOSTING

File hosting or storage of non-website data is prohibited. Accounts cannot be used as repositories for MP3, video, or software downloads unrelated to website hosting.

16. BACKUPS, DATA LOSS & BACKUP RECOVERY

You are responsible for maintaining backups. WEBHOSTER.ae may provide limited internal backups, but they are not guaranteed. Restoration fees apply.

17. CONTENT

You are responsible for all content stored or served on WEBHOSTER.ae servers. WEBHOSTER.ae is not liable for content loss or management issues.

18. RESELLERS

Resellers are responsible for their clients. WEBHOSTER.ae will not provide direct support to reseller clients. Resellers are accountable for their client’s actions.

19. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of the United Arab Emirates. Any disputes are subject to UAE courts. Process may be served via email.

20. DISPUTE RESOLUTION

Any dispute must first be addressed in writing to the other party. Parties have 30 days to respond before initiating legal action.

21. TECHNICAL SUPPORT BOUNDARIES

Support is limited to hosting-related issues. Coding, third-party app issues, or errors are not guaranteed support.

22. LEGAL THREATS & NON-PROFESSIONAL BEHAVIOR

Unreasonable threats or abuse toward WEBHOSTER.ae staff may result in warnings or termination of service.

23. REFUND / MONEYBACK POLICY

WebHoster.ae offers unconditional 30-day moneyback for new shared hosting orders. Refunds after 30 days are not accepted.

24. HOSTING REFUND POLICY

Customers are eligible for refund within 30 days. Setup charges, first month usage, and domain registration fees are deducted. Coupons or promotions are non-refundable.

25. DOMAIN REFUND POLICY

Domain registration fees are non-refundable, but ownership rights remain with the customer. Domains can be transferred to another registrar.

26. REFUND ELIGIBILITY

Only new orders are eligible. Renewal orders, domain renewals, or second-time accounts do not qualify for refund.

27. NON-REFUNDABLE PRODUCTS AND SERVICES

No refunds are offered for:

  • Domain Registration

  • Email Hosting

  • Reseller Packages

  • Web Development Services

  • VPS or Dedicated Hosting

  • Administrative, installation, or setup fees

  • Accounts terminated due to violation of Terms
